Welcome to our digital information platform, published by Observatory Southeast Asia at John Eccles House, Science Park, Robert Robinson Ave, Littlemore, Oxford OX4 4GP, UK (United Kingdom Companies House registration number 10747160). These are our terms and conditions for use of the platform, which you may access in several ways, including but not limited to the World Wide Web via newnaratif.com, mobile phone, and RSS feeds. By accessing the digital services of New Naratif, you agree to be bound by these terms and conditions.

Duty

New Naratif offers quality research and journalism (including, but not limited to, articles, videos, podcasts, and comics) on its website (www.newnaratif.com – the Website) and other digital and non-digital channels (the Service). The Service is available to anyone who takes out membership (hereinafter Membership), and those who have a membership (hereinafter a Member or Members). As a member you get unlimited access to the Service. Non-members can view the content only as members or correspondents share with them.

Membership and Access

You can request a membership via the Website and get full access to the Service. You are responsible for managing your credentials. If you lose your data or become aware any unauthorised use of your password or account identifiers by others, let us know immediately.

By signing up for Membership, you agree that:

(i) your account and password are personal to you and may not be used by anyone else to access the Website;

(ii) you will not create Memberships for the purpose of abusing the functionality of the site, or other users; nor will you seek to pass yourself off as another user.

Upon successful application for Membership, you can login with your own password and can make full use of the Service. Membership is intended for personal and non-commercial use.

Price and payment

After you apply for a Membership, you will automatically receive a confirmation email (please note your spam folder). New Naratif has the right to change the price of Membership, but will inform Members of this and raise the possibility of terminating Membership at any price increase. Payment must be made via the online payment service. When you apply for Membership, you will be given a choice to pay monthly or annually. If you pay per month, the membership fee will be charged monthly at the current rate. If you pay per year, the membership fee is charged annually at the current rate. If the payment period is exceeded, New Naratif has the right to cancel Membership and suspend access to the Service.

Duration and Termination

Membership is entered into indefinitely. You can cancel your membership at any time by sending us an e-mail (please include the email address you registered with). If you pay per month, the Membership will terminate on the last day of that monthly period. A monthly period runs from the day you joined up to the same day the following month. If you pay per year, the Membership will terminate on the last day of that annual period. An annual period runs from the day you joined up to the same day the following year. We regret that you are not entitled to a refund for any unused portion of your membership period.

If, for any reason, we believe that you have not complied with these terms and conditions, we may, at our sole discretion, cancel your Membership immediately and without prior notice. We may terminate your Membership, at our sole discretion, by emailing you at the email address you have registered stating that your Membership has terminated.

Gift memberships and trial memberships are not automatically renewed.

Liability

New Naratif is not liable for any damage you may suffer as a result of the use of the Service. You acknowledge that New Naratif is an authorial medium which (consequently) includes subjective information. Although New Naratif endeavours to provide accurate and quality information, we cannot guarantee that information provided through the Service is accurate. New Naratif is not liable for the consequences of such (possible) inaccuracies. We will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading or listening to the Service or any part of it.

We give no warranties of any kind concerning the website. In particular, we do not warrant that the website or any of its content is virus free. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties.

Although we will do our best to provide constant, uninterrupted access to the website, we do not guarantee this. We accept no responsibility or liability for any interruption or delay.

Privacy

New Naratif cares about your privacy. We treat personal data in a confidential manner and in accordance with the Data Protection Act. New Naratif processes the personal information provided by you only to enable use of the Membership and to communicate with you in this regard. New Naratif shall not use the personal data for commercial purposes and will not provide your personal data to third parties unless (a) you have agreed to this, (b) it is necessary for the purpose above, or (c) if New Naratif is required by law to do so.

User Content

If you share content through the Service (for example, in the comments under an article), you agree and represent that you have created that content, or you have received permission from, or are authorised by, the owner of any part of the content to submit it to the website.

You or the owner of the content still own the copyright in the content sent to us, but by submitting content to us, you are granting us an unconditional, irrevocable, non-exclusive, royalty-free, fully transferable, perpetual worldwide licence to use, publish and/or transmit, and to authorise third-parties to use, publish and/or transmit your content in any format and on any platform, either now known or hereinafter invented.

You acknowledge and agree that when you post content on the website or view content provided by others, you are doing so at your own discretion and risk, including any reliance on the accuracy, completeness, of that content. You further acknowledge and agree that the views expressed by you and other users in that content do not necessarily reflect the views of New Naratif, and we do not support or endorse any user content. We, or authorised third parties, reserve the right to cut, crop, edit or refuse to publish, your content at our or their sole discretion. We may remove your content from use at any time.

We accept no liability in respect of any content submitted by users and published by us or by authorised third parties.

You warrant that the content you submit to us is not obscene, threatening, harassing, libellous, deceptive, fraudulent, invasive of another’s privacy, offensive, defamatory of any person or illegal. You understand that the technical processing and transmission of the Website may involve (i) transmissions over various networks; and (ii) changes to content to conform and adapt to technical requirements of connecting networks or devices. New Naratif assumes no responsibility for the deletion or failure to store postings of content or other information submitted by you or other users to the Website.

If you are under 18, you confirm that you have permission of your parent or New Naratif to submit content.

The website and all content are protected by the copyright laws and other intellectual property laws of the United Kingdom, and are protected globally by applicable international copyright treaties.

You may download and print extracts from the website for your own personal and non-commercial use only, provided you maintain and abide by any author attribution, copyright or trademark notice or restriction in any material that you download or print. You may not use any website content for any other purpose without our prior written approval. Except as expressly authorised by the New Naratif, you are not allowed to create a database in electronic or paper form comprising all or part of the material appearing on the website.

We do our best to make our members happy. If you have a complaint, please let us know. Please send your complaint as fully as possible to feedback@newnaratif.com. Your complaint will be processed as soon as possible and we will endeavour to respond within within 14 days of receipt.

Changes to these terms and conditions of use

Please note that we may change these terms and conditions from time to time at our sole discretion and we reserve the right to do without your consent. Any revised terms and conditions will be applicable at the time of posting on the website. Please ensure that you review these terms and conditions regularly as you will be deemed to have accepted a variation if you continue to use the website after it has been posted.

Governing Law & Jurisdiction

These terms and conditions are governed by English law and the parties agree to submit to the exclusive jurisdiction of the English courts.

Indemnification

You agree to defend, indemnify, and hold harmless New Naratif, its parents, subsidiaries, and affiliates, and each of their respective officers, directors, and employees from any and all claims, liabilities, costs, and expenses, including, but not limited to, attorneys’ fees and expenses, arising out a breach by you or any user of your account of these terms and conditions or privacy policy or arising out of a breach of your obligations, representation and warranties under these terms and conditions.

No waiver

Our failure to insist upon or enforce any provision of these terms of service shall not be construed as a waiver of any provision or right of New Naratif.
